Figshare Plus end user terms

Use of the Figshare+ Service is governed by these terms and conditions (these “Terms”).

By submitting a request to use (should your request be accepted) and/or using the Figshare+ Service (“Request”), you agree to comply with these terms, as part of a legally binding contract with Digital Science & Research Solutions Inc. with offices at 625 Massachusetts Ave, Cambridge, MA 02139 USA and references in these Terms to “Figshare” shall be deemed to mean that entity for the purposes of the Figshare+ Service.

About Figshare +

As part of the Figshare+ Service, you will be able to deposit and publish a Submission on figshare.com that meets the Eligibility Requirements, subject to the payment of the Data Publishing Charge and limits set out in these Terms.

The Figshare+ Service is intended for use by individual researchers for sharing the outputs of their own scholarly research.

A “Submission” is defined as the data and materials that support a specific manuscript or publication or unpublished research project, as described in the Request, comprising up to a maximum of:

  1. Ten (10) Items (“Item” is a unique Figshare+ publication of any type (e.g. dataset, code, multimedia) that may include a single file or multiple individual files, that can be code, text, tabular data, images, etc, and that receives a unique Digital Object Identifier (DOI). An item can have 1 file or up to 5,000 files including zipped files; and
  2. One (1) Collection (“Collection” is a grouping of Items that allows users to group together relevant content from within Figshare into themed “Collections”. These Collections can be publicly shared with their own DOI and metrics. )

For a Submission to meet the “Eligibility Requirements” it must:

  1. Be submitted (or re-submitted) for review / publication in the 12-month period from the commencement of the Figshare+ Service;
  2. Be your own scholarly research output;
  3. Not contain any content prohibited by the section entitled “Content You Must Not Submit” or other part of, the Figshare terms and conditions;
  4. Be within the total storage limit that you have paid for, no single file larger than 5TB, and no more than 5,000 files per item; 
  5. Include files, description, and metadata that meets our minimum data quality standards.

Process to publish your Submission

Once you have deposited your Submission in the Platform and it is ready to be published, you will need to submit it for review and publication.  Where the Submission includes multiple Items, all Items must be submitted at the same time.  As part of the Figshare+ Service, we will then conduct a spot check on a sample of the files and review the metadata of the Submission, with the main aim of enhancing the Submission’s discoverability and reusability. 

Our review may identify that the metadata of the Submission: (1) could be improved, in which case we will make suggestions to you for such improvement; and/or (2) does not meet certain minimum standards, in which case you will be required to update the metadata before it can be published.  If our review does not identify areas for improvement and/or you notify us that you do not wish to implement any suggested improvements, the Submission will be published on the Platform. 

You acknowledge that if the Submission (including any updates) is not published, for example because it does not meet the Eligibility Criteria, you will not be entitled to a refund of any part of the Data Publishing Charge.  

Making changes to the Submission 

You will be entitled to re-submit your Submission with changes to the files or metadata for review and publishing up to a maximum of five (5) times in the 12-month period from the commencement of the Figshare+ Service (the “Submission Limit”). If you make changes to your Submission (including to the files or metadata) after it has been submitted for review and publishing (or after it has been published), other than changes that are suggested or required following our review, you will need to send your entire Submission to be re-reviewed and published and this will count towards the Submission Limit. 

Where you have reached the Submission Limit but require further revisions, or if you need to make changes to the files or metadata after the 12-month period, you will need to contact review@figshare.com and an additional fee may apply.  

Retention and Access

Data on Figshare+ is stored securely on Figshare-managed Amazon Web Service (AWS) S3 according to Figshare’s File Backup and Security Policy. Figshare is committed to a sustainable business model that supports continued access to research outputs hosted in its repositories.

Termination

Following termination, Submissions that are published pursuant to the Figshare+ Service may continue to be accessible on figshare.com, subject to the Terms, but unpublished Submissions may be deleted.

Privacy Policy

For information on how Figshare collects, processes and uses your personal information, please refer to the privacy policy which is subject to and forms part of these Terms.

FIGSHARE+ SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY, CONDITION OR GUARANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL LIABILITY HOWSOEVER CAUSED AND REGARDLESS OF THE LEGAL THEORY ASSERTED, ARISING FROM THE FIGSHARE+ SERVICE.

General

Together with the Figshare terms and conditions (www.figshare.com/terms), and any additional terms referred to therein (to the extent applicable), these terms constitute the entire agreement with you relating to Figshare+ Service, noting that we may modify or replace these terms at any time.
